These Terms of Service ("Terms") govern your access to and use of the BaRa website at bara.health and related services (the "Service"), operated by Avinasi Labs ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using BaRa, you confirm that you are at least 18 years of age and agree to comply with these Terms. If you do not agree, you may not use our Service.

2. Description of Service

BaRa is an AI-powered health agent that provides personalized, cycle-adaptive wellness protocols. The Service integrates data from wearable devices, lab results, and user inputs to generate health recommendations. BaRa is currently in pre-launch, and features may change as we develop the product.

3. Not Medical Advice

BaRa is not a medical device and does not provide medical advice, diagnosis, or treatment. The health insights, recommendations, and protocols provided by BaRa are for informational and wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you received from BaRa.

If you think you may have a medical emergency, call your doctor or emergency services immediately.

4. User Accounts and Waitlist

When you join our waitlist or create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials.

5. Health Data

By connecting wearable devices or uploading health data, you grant us permission to access, process, and analyze that data solely for the purpose of providing our Service. Your health data is governed by our Privacy Policy.

You retain ownership of your health data. You may request export or deletion of your data at any time.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access another user's account or data
• Reverse engineer, decompile, or attempt to extract the source code of our software
• Use the Service to generate or distribute misleading health claims
• Interfere with or disrupt the integrity or performance of the Service
• Use automated means to access the Service without our written permission

7. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by Avinasi Labs and protected by intellectual property laws. "BaRa," "Cycle Intelligence," and related marks are trademarks of Avinasi Labs. You may not use our trademarks without prior written permission.

8. Subscriptions and Payments

When BaRa launches, certain features will require a paid subscription. Pricing, billing cycles, and cancellation terms will be communicated before you are charged. Founding members who join the waitlist may receive special pricing, the terms of which will be disclosed at launch.

9. Limitation of Liability

To the maximum extent permitted by law, Avinasi Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or health outcomes, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that health recommendations will achieve any particular outcome.

11. Indemnification

You agree to indemnify and hold harmless Avinasi Labs, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for conduct that violates these Terms. You may stop using the Service and request account deletion at any time by contacting us.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
